TAX RECOVERY

Sales Taxes, such as GST, PST, HST, and QST and Intra-provincial taxes. We also have expertise in Payroll Taxes, Customs and Duty Drawbacks, and R & D Tax Credits.

 We constantly review current and pending tax and customs legislation, looking for opportunities that our clients should be aware of and take advantage of. Custom Duties are fees levied by the Federal government on goods brought into Canada from other countries. The rates vary widely and are dependent on the type of goods being imported.

 At GetGoing we deal with Issues and apply for Rulings on a regular basis. We have on-staff Counsel dedicated to this end. If your company feels that you have an Issue or you are paying Tax or Duties that are incorrect or unfair we will act on your behalf.

Get Going works solely on a contingency basis. When you receive your money, We get paid. In the event that there are no recoveries, then there is no cost to you. Get Going will not receive anything for its services. Absolutely no risk to you, the Client and our findings are strictly confidential.

 We will efficiently analyze the audit findings in detail, correlate our findings with your records, and develop a defensive audit strategy to minimize or eliminate the financial impact on your business.

 Areas where tax liabilities are found are brought to the client's attention in confidence - use of the information is left to the client's discretion.

 A complete and detailed report will be issued with our findings fully documented supporting your refund claim.

 We are not here to replace your CA.  If you have previously engaged another consulting company who has reviewed your tax exposure, there are many nuances and issues within the various Tax Acts that may not have been reviewed by that firm.  We can provide a level of increased confidence by giving you a second opinion on whether or not deductions may have been missed.

 If the application or claim for refund is under review by the Government authority, GETGOING shall continue to update and file claims on behalf of the CLIENT for all related transactions until a final decision has been rendered by said Government authority. There shall be no fee payable to GETGOING for any savings relating to transactions occurring after a final decision has been rendered.

 If by chance you are already making claims under the same issue, of course there would be no obligation toward GetGoing, whatsoever.

 I would hate to see your company miss out on an opportunity to recover any amounts that may be owed you.  We have often experienced a similar situation where we were allowed in nevertheless and have indeed found items that were not discovered by the previous consultant.  This is not to say that we are any better than they are, it is just that each firm may have their own specialty and focuses.  I am quite sure that we are not aware of every opportunity available as well.  That is why we do not focus on general reviews and target specific issues we feel would give our clients the greatest returns for the amount of time and effort involved in the preparation of the claim.

 *****It's a fact: taxing authorities focus on a company's compliance with the Act. We focus on entitlements, and our specialists have recovered taxes for clients even after other tax recovery firms and/or taxing authorities have audited the client.


 

Duty and Import Tariffs

 

There are two major recovery opportunities in Duty; the first is on the classification of the goods themselves and the Terms of Purchase and the second is on the subsequent export of imported goods.

 The rules for rates of Duty can seem arbitrary. Goods are differentiated on the smallest of differences in product. Get Going can often reclassify goods into more attractive duty categories and achieve refunds for clients.

 Duty drawbacks occur when a good that was imported is subsequently exported without being used in Canada. This can be a complex procedure as component parts that are incorporated into a finished product also qualify for the drawback.

 If you are an importer, Get Going may be able to reduce the duties you pay.

Lease Audit Services

Commercial and Retail Lease Consulting operating in Canada and the United States, specializing in recovering overpayment of Common Area and other direct billing from Landlords due to errors or misapplication of specifics in your Lease Agreement.

 I know through my experience in Retail and dealing with Landlords there are many opportunities for Landlord's to take advantage of their Tenants inexperience and many overcharge based on their current lease clauses. It is common for Landlords to make errors on the annual expense invoices. I have found, especially in Retail Leasing, they always make mistakes on things such as Square footage, not applying specific Lease clauses properly.

 Unfortunately, most leases require the tenant to identify the errors and bring them to the attention of the Landlord within a limited period of time.  Because most tenants don’t have the time or resources to do this, they simply pay their bills as rendered.

 Some common types of errors can range from simple miscalculations to misinterpretations of lease language.

The Trick is to negotiate and write the Lease Agreement properly and to the Tenant's advantage to begin with!

 While most commercial leases share a common basic structure, leases are individually negotiated and may contain unique terms and conditions that will create errors if not followed.

 Things to watch out for:

-Proportionate share allocation errors, GLA and tenants area not accurate

-Base year inadequacy

-Expense Caps not implemented

-Improper charges for Capital Expenditures

-Excessive or inappropriately applied management fees to exempt items

-CPI miscalculations

-Commencement date inaccurate

-Excessive Utility Charges, metering errors
